West Virginia is one of the nation's unhealthiest states by a number of metrics, yet it became the first state to ban artificial food dyes.
West Virginia has become the first state to ban smoking in cars when children are present, with the new law signed by Governor Jim Justice on March 8, 2023, set to take effect on July 1, 2023. The legislation, aimed at protecting children from secondhand smoke, makes it a misdemeanor to smoke or vape in a vehicle with a minor under 16 present, punishable by a fine of up to $25 without any surcharge. This move follows similar laws in other states that ban smoking in cars with children, but West Virginia is the first to officially enact such a ban. The law was supported by health advocates who argue that secondhand smoke exposure in confined spaces like cars can have serious health consequences for children.
